must be read and signed in order for the application to
be accepted by Mackintosh International College (Australia).

AGREEMENT CONDITIONS
This Enrolment Agreement may be terminated by Mackintosh
International College (Australia) Pty Ltd in any of
the following circumstances:
a. Failure of the student to meet minimum progress standards
or attendance
b. Failure of the student to adhere to rules, regulations,
policies and procedures as outlined by the college
c. Failure of the student to pay the required fees; or
d. The unavailability of a program/course for any reason
whatsoever.
The exact definition of a course should be defined as, “the
entire scheduled total of tuition enrolled to undertake
and complete at Mackintosh International College (Australia)
Pty Ltd.”
FEES AND CHARGES
I undertake to diligently pay the fees and charges of Mackintosh
International College (Australia) Pty Ltd as prescribed
and or as amended if required during the tenure of my
course.
For the purposes of this agreement, fees and charges include
but are not limited to; tuition fees, application and materials
fees, excursion and related expenses, graduation attire,
OSHC and Homestay fees (where appropriate). It is the student’s
responsibility to be aware of payment deadlines and be
aware of college policies relating to payments.
Payment Schedules
All fees and dues payable shall be made to Mackintosh College.
Failure to meet payment deadlines may result in the student
being suspended from attending studies being undertaken
at that time. For those on student visas, this will result
in non-attendance which needs to be reported to the Department
of Immigration and Multicultural and Indigenous Affairs
(D.I.M.I.A) which by law requires every international
student on a student visa to maintain a minimum of 80%
attendance in their course. Please see ATTENDANCE & ACADEMIC
PERFORMANCE below.
Students on payment plans wishing to withdraw from their
course prior to completion will be required to pay 50%
of their total remaining tuition fees plus an additional
$150 administration fee. These fees must be paid within
30 days of the withdrawal date of the course. Failure to
pay these fees may result in any one or all of the following:
a. Any statements of attainment of results will be withheld
until payment is received.
b. The debt will be transferred to Mackintosh College’s
debt collection agency. The full costs of which will be
borne by the student.
c. The student’s enrollment will be cancelled which
will be reported to D.I.M.I.A. This may result in the student’s
visa being withdrawn.
d. Students with unpaid fees will not be permitted to re-enrol
in any course at Mackintosh College.
REFUND POLICY
Full Refund of Tuition Fee
1. A student will be entitled to a refund of fees in the
following circumstances:
(a) If the student's application for visa is rejected.
And in this case 1(a) (i), (ii), (iii), (iv) and (v) apply
(i) The written application for a refund must be received
within 28 days (inclusive) of the visa application being
rejected. Tuition fees will be refunded in full within
28 days (inclusive) of receipt of an application (made
in writing) for a refund (less an administrative fee of
AUD$120).
ii) Written applications for a refund request received
after 28 days (inclusive) of the visa application being
rejected incur a 75% refund of tuition fees and will be
refunded after 28 days (inclusive) of receipt of an application
(made in writing) for a refund (plus an administrative
fee of AUD$120).
(iii) Application fee and Accommodation Placement fee are
not refundable.
(iv) Written proof of visa rejection must be presented.
(v) Overseas Student Health Cover will be refunded by the
College or health fund (whichever applies) within 28 days
(inclusive) if a student cancels before the start of the
course.
(b) If Mackintosh College (Australia) Pty Ltd is unable
to deliver the course in which the student has enrolled.
(i) In the case of 1(b) all monies paid will be refunded
in full within 14 days (inclusive)
(ii) Mackintosh may offer another course or part thereof
in replacement of the original course. Where this is agreed
on by both the college and the student, the college will
not be liable for refund of the original course monies.
Partial refund of Tuition Fee
2. A partial refund may be granted if written notice of
cancellation is received by Mackintosh international
College (Australia) Pty Ltd, as in the following circumstances;
(a) If cancellation is made more than 28 days before the
commencement of the course, a refund of 75% of tuition
fees may be refunded.
(b) If cancellation is made less than 28 days (inclusive)
but no less than 7 days before the commencement of the
course, a refund of 65% of tuition fees may be refunded
(c) And, if partial refund is approved, or if the course
ceases to be delivered.
(i) partial refunds will be paid within 28 days (inclusive) of receipt of the
necessary written refund application
(ii) the retained amount will not exceed 12 weeks' tuition fee
No refunds will apply in the following circumstances
3. An application for refund will not be considered in
any of the following circumstances
(a) If the student cancels or withdraws enrolment after
the start of the course or within 7 days of the commencement
of a course in which he/she is enrolled
(b) If the student takes unauthorised leave during the
course
(c) If the student is excluded by Mackintosh International
College (Australia) or has a visa cancelled by the Australian
Department of Immigration, Multicultural and Indigenous
Affairs due to failure to meet course requirements such
as unsatisfactory attendance, inappropriate behaviour or
unsatisfactory academic performance.
(d) For fraudulent or forged applications which led to
the enrolment being accepted.
(e) For application, accommodation placement, the first
two weeks of prepaid homestay or airport pickup fees, regardless
of written notice period.
(f) For public holidays in Australia or official closures
of Mackintosh International College (Australia) Pty Ltd
for term breaks or the annual College conference
(g) If the student cancels Overseas Student Health Cover
after the course starts
Processing of Refunds
4. Applications for refunds will be assessed by and paid
at the sole discretion of the College Board of Mackintosh
International College (Australia) Pty Ltd. And,
(a) The timelines for approved refunds are mentioned above
(b) Refunds are paid to the person / organisation responsible
for the initial payment of fees
(c) Refunds are issued via Electronic Funds Transfer (EFT)
Transfer/exchange and early completion of courses
Once a course has commenced students are permitted to transfer
to another field of study after providing a written request
to Mackintosh International College (Australia) Pty Ltd
management, however course transfers or exchanges between
students is not permitted. Only exchanges between immediate
family (i.e., husband, wife, brother, sister) are permitted
within 2 months of the original course cancellation date.
Changes of faculty courses or early completion of English
and entry into a Certificate or Diploma course (full or
partial) incur an administration fee of $120 This is subject
to an English proficiency test provided internally by Mackintosh
International College (Australia) Pty Ltd.
English proficiency tests for students requesting early
termination of their allocated English Course will be charged
an administration and teachers fee of $100 per test.
AGENTS
All agents representing students must make themselves known
on the students enrolment form or they will not be eligible
for a commission payment if they approach the college
after the students CoE has been issued. Although Mackintosh
International College (Australia) Pty Ltd will endeavor
to do its best to administer efficient student and agent
relationships, the College cannot be held responsible
for agents who do not fill in their own personal information
when enrolling a new student.
Current students enrolled at Mackintosh International
College (Australia) Pty Ltd cannot apply or support the
College as an agent.
ATTENDANCE & ACADEMIC PERFORMANCE
Mackintosh College believes that good attendance is necessary
for successful progress in academic studies. The Department
of Immigration and Multicultural and Indigenous Affairs
(D.I.M.I.A) requires every international student on a
student visa to maintain a minimum of 80% attendance
in their course. The college is obliged by Australian
Law to report bad attendance and unsatisfactory academic
performance of students on Student Visas to the Immigration
Department (D.I.M.I.A).
Medical certificates must be obtained for sick days and
the college must be phoned when students expect to be absent
due to sickness. Work does not give students an excuse
for absence. Students on student visas can only work a
maximum of 20 hours per week and this MUST BE OUTSIDE COLLEGE
TIME.
ALLOCATION OF CERTIFICATES/DIPLOMAS
Upon successful completion of the program, the student
will be issued with a Diploma/Certification & Summary
of Completed Modules. By accepting the student’s
Enrolment Application, Mackintosh International College
does not warrant or represent that the student is suitable
for the program, or will successfully complete the program
or find employment upon completion of the program.
Additional Certificates
Mackintosh College is able to print additional or replacement
certificates for students on request. Costs of these
vary, please see the Mackintosh website www.mackintosh.edu.au
for more details.
Mackintosh College will not issue statements of attainment
or certificates to students who have outstanding fees.
CHANGE OF ADDRESS
It is the duty of the student to provide the college with
up to date contact details. Any changes in contact details
should be updated with student services within 3 days
of the change occurring.
RULES & REGULATIONS
If this application is accepted, the student agrees to
abide by the rules of the College as set out in the Student
Handbook. Students of Mackintosh International College
(Australia) Pty Ltd need to attend class regularly and
carry out the instructions of the management and staff
while on the College premises.
CONSUMER PROTECTION
(a) Nothing in this agreement removes the right to take
further action under Australia's consumer protection
laws.
(b) The dispute resolution process of Mackintosh International
College (Australia) Pty Ltd does not limit the student's
right to pursue other legal remedies.
(c) If a student requires assistance from outside Mackintosh
International College (Australia) Pty Ltd they have the
option to contact the office of Education Queensland International
